These Terms of Service ("Terms") govern your access to and use of FaceToCartoon ("FaceToCartoon", "we", "us", or "our") at facetocartoon.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
FaceToCartoon is an online, AI-powered tool that converts a photo you upload into a cartoon-style image. The Service operates on a credit system: generating an image consumes credits from your balance.
2. Eligibility and accounts
You must be at least 16 years old (or the age of digital consent in your country) and able to form a binding contract. You are responsible for the information in your account, for keeping your login credentials secure, and for all activity under your account. Provide accurate information and keep it up to date.
3. Credits and plans
- Generating an image consumes credits. Higher-resolution outputs may cost more than one credit per image.
- New accounts may receive a limited number of free trial credits. Free-trial outputs are watermarked.
- Paid plans include a monthly credit allowance. Credits are intended for use within their validity period and may expire as described at checkout and in your account; unused monthly credits do not necessarily roll over.
- Credits have no cash value and are not transferable except as required by law.
4. Billing, subscriptions, and Merchant of Record
- Paddle is our Merchant of Record. When you purchase a plan, your order and payment are processed by Paddle, and your purchase is also subject to Paddle's buyer terms. Paddle handles payment, invoicing, and applicable taxes.
- Prices are shown in US dollars unless stated otherwise. Applicable taxes (such as VAT or sales tax) are calculated and added at checkout based on your location.
- Subscriptions renew automatically at the end of each billing period (monthly or annual) until you cancel. Annual plans are billed yearly, with credits released monthly.
- You can cancel at any time from your account or billing portal. Cancellation stops future renewals; your plan remains active until the end of the current paid period.
- Refunds are handled in accordance with our Refund Policy.
5. Acceptable use
You agree that you will not use the Service to:
- Upload images you do not own or have the necessary rights and permissions to use.
- Upload images of other people (including public figures) without their consent, or images of minors without the consent of a parent or guardian.
- Create content that is unlawful, defamatory, hateful, harassing, sexually explicit, deceptive (including deepfakes intended to impersonate or mislead), or that infringes anyone's rights.
- Violate any applicable law or third-party rights.
- Attempt to disrupt, abuse, reverse engineer, scrape, overload, or circumvent the security, rate limits, or credit system of the Service.
We may suspend or terminate accounts that violate these rules.
6. Your content and ownership
You retain ownership of the photos you upload ("Input"). You represent that you have all rights necessary to upload your Input and to have it processed by the Service. You grant us a limited, worldwide licence to host, process, and transmit your Input to our AI provider solely to provide the Service to you.
Subject to your compliance with these Terms and payment of any applicable fees, you own the cartoon outputs you generate ("Output") and may use them for personal and commercial purposes permitted by your plan. Free-trial Outputs are watermarked and intended for evaluation. You are responsible for how you use your Outputs.
7. AI-generated content
Outputs are produced by AI and may be imperfect, inaccurate, or vary between generations. We do not guarantee any particular likeness, quality, or result. You are solely responsible for reviewing Outputs before use and for ensuring your use is lawful.
8. Intellectual property
The Service, including our software, branding, logos, and website content, is owned by FaceToCartoon and protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the maximum extent permitted by law, FaceToCartoon will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three (3) months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnity
You agree to indemnify and hold harmless FaceToCartoon from any claims, damages, and expenses arising from your Input, your Outputs, your use of the Service, or your breach of these Terms.
12. Suspension and termination
We may suspend or terminate your access if you breach these Terms or to protect the Service and its users. You may stop using the Service and close your account at any time. Sections that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will survive.
13. Changes
We may update the Service and these Terms from time to time. We will update the "Last updated" date above and, where appropriate, notify you. Your continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law rules, and the courts of Pakistan will have exclusive jurisdiction, except where mandatory consumer-protection laws of your country of residence provide otherwise. Your statutory consumer rights are not affected.
